Abstract

The debate on the feasibility, the use and the contents of a code of EU administrative procedures has intensified since the entry into force of the Lisbon Treaty, which introduced art. 298 TFEU, a provision that could be relied upon as the legal basis for the adoption of an EU codification regulation. The ‘European Code of Good Administrative Behaviour', drafted by the European Ombudsman, and endorsed by the European Parliament in September 2001 and the adoption of the European Parliament legislative initiative resolution of 15 January 2013 stimulated academic debate on the issue. In this context, the PRIN project 2012 (2012SAM3KM) financed by Italian Government, which involved six Universities, sought to consolidate and further develop efforts undertaken in Italy in the framework of the network of academics, known as ReNEUAL, which started working in 2010.The research unit of Naples, coordinated by Prof. Roberto Mastroianni, in particular assessed the issues related to the legal basis for the adoption of a codification regulation and the sources of inspiration for the recognition of common procedural rules. The workshop seeks to present the results of the PRIN research and to further stimulate academic debate in the light of the adoption by the European Parliament, in 2016, of resolution 9 June 2016 laying down the proposal for a regulation for an open, efficient and independent EU administration (2016/2610(RSP)).

Participants

Roberto Mastroianni,is Full Professor of European Union Law at the University ‘Federico II’, School of Law, and

Head of Legislative Office at Department for European Affairs, Italian Government. He served as Referendaire at the European Court of Justice in Luxembourg, in the Cabinets of Advocates General Giuseppe Tesauro and Antonio Saggio. He holds a PhD from the University of Bologna and a LL.M. from the Penn State / Dickinson School of Law (Carlisle, PA, USA). He was visiting Professor at American University, College of Law (Washington, DC) and Université Panthéon-Assas, Paris 2 (Paris, France), Yale Law School (New Haven, CT, USA); Rutgers (Camden, NJ, USA), Denver Law School (Denver, CO, USA).

Fabio Ferraro is Associate Professor of EU Law at the University of Naples "Federico II", School of Political

Sciences. He Practice in Rome representing undertakings before the Court of Justice, the European Court of Human Rights and the European Commission, as well as the Competition Authority and the administrative courts.

Amedeo Arena Associate Professor of European Union Law at the University of Naples "Federico II", School of

Law, and an Italian qualified lawyer admitted to practice before Italy's highest courts, with experience in European Union, competition, regulatory and State aid matters. He was Visiting Professor or Fellow at, among others, the University of Amsterdam, the Catholic University of Portugal, King's College London, University College London, the University of Denver, New York University, and the University of Tokyo. Professor Arena took part as legal expert in a number of international reserach projects and provided legal expertise, inter alia, to the European Commission, the European Parliament, the European Global Navigation Satellite Systems Agency, the European Audiovisual Observatory of the Council of Europe, and the Supreme Court of Korea.

Oreste Pallotta is Assistant Professor of EU Law at the University of Naples "Federico II" School of Political

Sciences, where he teaches also Competition Law.

Adriano Maffeo is Assistant Professor of EU Law at the University of Naples "Federico II", School of Law. He has

been contract professor of Eu procedural Law at University of Neaples "Pegaso" and visiting scholar at Université Panthéon-Assas Paris 2 (Paris, France) and at European University Institute in Florence (Italy).
