1. EXECUTIVE SUMMARY

• This report is the ninth report established by Alstom (Switzerland) related to Alstom

Scope of work as defined in the “220MW CCPP SKOPJE / MACEDONIA Joint Contract Agreement”

• This report covers the period from 1st of February 2008 to 29th of February 2008. • Main events during the period:

o Engineering is on-going

The main foundation design is ordered based on the soil investigation and soil bearing capacity received from GAMA on the 21st February.

GAMA requested information in the event of equipment re-assembly at site. ALSTOM is waiting for the official confirmation for the delivery disassembled of the Gas turbine and its reassembly at site.

o HRSG missing information impacts ST engineering o 4th invoice payment related to rotor forgings received

4.1. ENGINEERING STATUS

Engineering is ongoing and some purchase orders have been prepared during the reporting period.

Important input documents from GAMA are not complete and for some cases evening missing. These documents are preventing ALSTOM to proceed with engineering work and may have further an impact, for already placed purchase orders, see attachment 4 for details.

GAMA send feedback to several documents during the reporting period, however GAMA’s review of some engineering document are still overdue.

4.1.1. CIVIL INPUT ENGINEERING

The main foundation design is ordered based on the soil investigation and soil bearing capacity received on the 21st February from GAMA.

4.1.2. MECHANICAL ENGINEERING

An updated noise study was revived on 4th February from GAMA together with a

request of reducing the noise from the air intake system. A phone conference was held on the 14th February to further clarify the requirements. ALSTOM has

requested a quotation from G+H Schallschütz, based on the requirements from GAMA.

The outstanding information from seismic concept is a risk for mainly the air intake system, however also other equipments might be affected. An updated seismic concept was send to Colenco on the 29th February however the comments made

on the 19th November 2008 in CHAP/GPS/0159 is still valid.

4.1.3. ELECTRICAL ENGINEERING

Engineering ongoing according to schedule, except for:

• The design for the ST neutral point cubicle is on hold. Input received on the 29th February. ALSTOM will review the input.

ALSTOM commented the short circuit calculation on the 4th November 2007 ref.

CHAP/GPS/0107 and its revision B on the 8th February 2008 ref. CHAP/GPS/0224.

The minimum grid short circuit capacity at 110kV connection point is urgently needed to calculate the power system stabilizer parameters, which are stated in the Transfer Function Diagram. The transfer function diagram is required to achieve grid code compliance.

GT Rotor: Rotor welding Ultrasonic test has been confirmed to TE-TO [letter 605-GPS-TTA-0202] to take place on 6th and 7th of March 2008. ALSTOM did not receive confirmation

from TE-TO and will proceed with the test. In case TE-TO s not present, test results will be sent to TE-TO.

4.2.2. SHIPPING & TRANSPORT

• Stator of ST Generator and its accessories have been delivered and stored at Warehouse in Rotterdam/NL. AIM and Foundation Parts will be picked-up in KW9/10 and should be in Rotterdam after Easter (KW13). • Inspection should be done at warehouse in Rotterdam for these Parts.

Inspection time will be defined in due course.

• Alstom did not receive any comment to their letter 605-LT-GPA-TTA-M0173 dated 28 January 2008 (also ref. CHAP/TETO/031 dated 28 January 2008, concerning the “equipment or piece of equipment Owner or it’s Engineer would like to inspect as per clause 7.3 of the contract”

6. PAYMENT STATUS

• Advance payment has been paid to the consortium in 31 may 2007. • Performance bond has been issued and submitted to the Owner.

• Applications to Serv for the Financial Closure of ALSTOM portion have

been submitted.

• Finance Security SBLC opened by TETO

• Amendment to performance bond as defined in Supplement 1 to

Contract Agreement issued to TETO

• Second invoice submitted by ALSTOM to TE-TO. Payment due by

25.08.2007

• Second invoice (7.161.197 €) paid by Landesbank Berlin on 28th of

August.

• Milestone “First issue of GT and ST P&IDs” has been reached on August

28th, (letter GPS-TTD-2007-0055 dd 28.08.07). Third invoice has been

submitted by ALSTOM to TE-TO letter CHAP/TETO/0019 dd 11.09.2007. Payment due by 11.10.2007

• Request for disbursement of third payment sent to LBB letter

CHAP/LBB/002 dd 16/09/2007.

• Third payment (4.774.131.50 €) received from LBB on 5th of October.

• 4th invoice related to payment of Rotor forgings submitted by ALSTOM to

TE-TO. As these long lead items were ordered long before the suspension started, this particular activity could not be suspended.

9. MAJOR CONCERNS AND CORRECTIVE ACTIONS

Missing of incomplete documentation from GAMA.(acc. To JCA)

• HRSG characteristics (including start-up curves and operational parameters range) - within the package received on 19.11.2007 start-up curves are missing and boundary parameters are not given.

• Cooling water diagram and parameters (definition of minimal, nominal and maximal conditions) – still not yet received by TSR. Together with the fact, that steam turbine design has been frozen during the 2nd Design Review dd 10.12.2007 and the manufacturing process is progressing – an exposure of underperformance exists in case GAMA comes up with the cooling water parameters significantly deviating from the contractual boundaries. This risk cannot be verified without GAMA’s input.
