NEGOTIATED PROCEDURE PURSUANT TO ARTICLE 36 OF THE PARAGRAPH 2 B) OF THE CODE OF PUBLIC CONTRACTS, FOR THE SUPPLY OF # 1 MACHINE FOR SMALL PUNCH CREEP TESTS FOR INAIL RESEARCH ACTIVITIES
MARKET SURVEY
By Contracting Decision number 306 of 18 December 2018 the Director of the Central Directorate Procurement authorized a negotiated procedure, pursuant to art. 36, paragraph 2, lett. b) of the Code of public contracts, to award the supply of #1 small punch creep testing machine for Inail research activities.
The machine is necessary to support the research, verification and testing activities of the Department of Technological Innovations and Safety of Plants, Products and Anthropic Settlements (Ditsipia), in particular for "Small Punch" tests on installations and equipment subject to creep.
This is a particularly relevant test method to predict life duration of plants components operating under high temperatures and in creep conditions, used to measure viscous creep itself, as well as tensile strength and tenacity.
The estimated amount of the contract is € 190,000.00 excluding VAT.
The costs for safety measures related to interference risks are estimated to be zero, as indicated in the document issued pursuant to art. 26, paragraph 3 ter of the Legislative Decree 81/08 (D.U.V.R.I. ricognitivo, i.e. preliminary Single Document for the Assessment of Interference Risks), in which the standard interference risks for the supply and installation of machinery and equipment are assessed.
Economic operators referred to art. 45 of the public contracts Code are allowed to participate, provided they meet the requirements indicated below. To temporary groupings of companies the provisions of art. 48 apply; to consortia, also established in the form of companies set up by consortia, the provisions set forth in articles 47 and 48 of the same code apply.
For the purposes of participation in the procedure, the following requirements apply:
- GENERAL MORALITY REQUIREMENTS:
- non-existence of the grounds for exclusion pursuant to art. 80 of the code of public contracts.
- PROFESSIONAL ABILITY REQUIREMENTS
- enrolment in the Trade Register, or else in a similar professional register - competent according to the place of establishment - envisaged for the activity that makes the subject of this tender procedure or else, in the case of companies established in a EU Member States other than Italy, in a similar register of the Member State according to the indications available in the online register of certificates (e-Certis). In the case of a company located in a non-EU country, signatory of GPA (Government Procurement Agreement) pursuant to art. 49 of the Italian public procurement code, this requirement must be demonstrated by means of a sworn declaration or according to the procedures in force in the country in which the company is established.
- ECONOMIC AND FINANCIAL STANDING
- at least two suitable bank statements issued by banks or authorized intermediaries pursuant to Italian Legislative Decree 1 September 1993, n. 385;
the economic operator, who for justified reasons is not able to issue the required references, can prove, pursuant to art. 86, paragraph 4, of the code of public contracts its economic and financial standing by any other document considered suitable by the contracting authority.
The interested economic operators can submit a specific expression of interest, by sending the attached form (Annex 1 - Expression of interest) to the following address of certified email: [email protected] (in case of availability of certified email according to Italian standards) or [email protected] (in case of use of normal email, due to unavailability of certified email according to Italian standards), and mentioning the following wording in the subject line : "Application to participate in the negotiated procedure for the supply of 1 small punch creep testing machine ".
Applications must be received within 20 calendar days of the date of publication of this notice.
The expression of interest must be filled-in and signed by the legal representative of the competitor or by a legally authorised proxy. In the latter case, a copy conforming to the original of the relative power of attorney must also be attached.
This notice is aimed at obtaining applications, and does not constitute a contract proposal nor does it in any way bind Inail to the continuation of the procedure or the selection of the competitors to be invited.
Inail reserves the right to suspend, interrupt, cancel or withdraw at any time and for any reason the present procedure, without, in such cases, giving the applicants any right to claim for whatever called indemnities or compensations for expenses incurred, including loss of earnings or costs related to the presentation of the expression of interest.
Inail will invite to the tender procedure at least 5 companies operating in the relevant industry, if available. No upper limit will be set to the number of invited companies.
This procedure will be awarded with the criterion of the lowest price pursuant to art.
95, paragraph 4, lett. b) the code of public contracts, as it concerns equipment with characteristics sufficiently standardized for the purposes of the research activities described above.
The data provided by the applicants will be treated in accordance with Legislative Decree no. 196/2003 exclusively for the purposes connected with the completion of this procedure.
