VERSO UN APPROCCIO INTERDISCIPLINARE E TRANSFRONTALIERO AL RISARCIMENTO DEL DANNO ALLA PERSONA: GLI OBIETTIVI E I CONTENUTI DEL PROGETTO EUROPEO AREYOUFINE?
Congresso Nazionale - Melchiorre Gioia
AreYouFine
• Progetto finanziato Erasmus + Azione K2 partenariati strategici.
• Nuovo corso di formazione online in materia di quantificazione del danno attraverso l’uso di tecniche e l’applicazione di principi di
biomeccanica
• Giuristi, ingegneri, medici-legali
• Spagna (IBV, USC), Italia (SSSUP), Polonia (Ciop), CEREDOC, IALM
Obiettivi
piattaforma online
Caratteristiche
• Contenuti e materiali in inglese, italiano, spagnolo e polacco
Research Output WP1
• Report Personal injury assessment in extracontractual liability. Focus on traffic accidents (Italia, Spagna, Polonia + Francia, Belgio, Portogallo + Regno Unito, Ungheria e Olanda)
• Questionario sui bisogni formativi in materia

Target Group
Common institutions:
• Insurance Company (IC)
• Private clinical services of the IC
• Private healthcare providers
• Private medical services
• Tribunals and Courts
• National Healthcare Service
Target Group
Main actors and professional profiles:
• IC physicians - experts in BHE.
• IC managers of the accident.
• Lawyers.
• Forensic doctors/ BHE experts.
• Clinical professionals.
Legal Frameworks
- Combinazione di ADR e tutela giudiziaria - Nuove riforme legislative
- Nuove applicazioni giurisprudenziali
- Permangono difficoltà ad identificare criteri oggettivi che consentano un’armonizzazione europea
Main Musculoskeletal Pathologies
• In Spain WAD is present in over 80% of accidents
• In Italy minor cervical spine injuries take as a percentage of all bodily injuries up to 66%.
• In Poland: intracranial trauma (14.4%); superficial trauma to the head (12,3%); Superficial injuries involving multiple body regions (10.3%).
Role of Biomechanics
• No official data on the role of biomechanical assessment are available. However, legal frameworks enable the use of biomechanics as an adjunctive non-invasive exam for ascertaining and evaluating the degree of permanent impairment.
• An understanding of injury mechanics begins with an appreciation of how individuals respond to the kinds of perturbations that produce whiplash injury.
• Damage to cervical ligaments from whiplash trauma has been well studied, yet these injuries are still often difficult to diagnose and treat.
