1. ORDINI
Onde evitare malintesi e disguidi, Arte Mecano non accetta di norma ordini telefonici o verbali. Eventuali deroghe a quanto sopra - che rivestiranno quindi carattere di eccezionalità e non costituiranno in alcun caso un precedente - sono a totale rischio e pericolo del committente. ARTE MECANO srl non accetterà quindi alcun reclamo e/o contestazione derivanti da consegne a fronte di ordini non trasmessi per iscritto.
2. MODIFICHE E ANNULLAMENTI ORDINI
Arte Mecano si riserva la facoltà di accettare o meno modifiche o annullamenti d’ordine in funzione dello stato di avanza- mento della commessa stessa. In ogni caso non vengono riconosciute modifiche o annullamenti d’ordine che non siano espressamente accettati per iscritto dalla nostra Società.
3. TERMINI DI CONSEGNA
I termini di consegna riportati nelle offerte e in qualunque altro documento di Arte Mecano ivi compresi quelli riportati nella conferma d’ordine, decorrono dal giorno del ricevimento ordine ed hanno valore semplicemente indicativo. Arte Mecano si ritiene sollevata da ogni responsabilità qualora annullasse totalmente o parzialmente l’ordine conferitole o ne ritardasse l’evasione nei casi sottoelencati:
• Casi di forza maggiore o evenienze quali fatti di guerra o turbamento dell’ordine pubblico, penuria di materie prime, re- strizione di fonti energetiche, scioperi, errori o carenze imputabili a fornitori o subappaltatori di Arte Mecano.
• Casi in cui i ritardi siano imputabili all’acquirente particolarmente per quanto riguarda la comunicazione dei dati ritenuti indispensabili da parte di Arte Mecano e non forniti in tempo utile.
• Casi in cui le condizioni di pagamento non vengano rispettate dall’acquirente ai sensi art. 1460 - 1461 C.C.
I ritardi imputabili ad Arte Mecano non possono in alcun caso giustificare l’annullamento dell’ordine. Essi potranno dar luogo ad un risarcimento soltanto nel caso e nella misura in cui siano state previste penalità a tali effetti, preventivamente formaliz- zate per iscritto.
4. IMBALLO
Salvo accordi diversi, stipulati per iscritto, le spese di imballo si intendono a carico del Cliente.
5. TRASPORTO E SPEDIZIONE
Le nostre condizioni di resa normali si intendono franco nostri magazzini. Il nostro obbligo di fornitura si intende adempiuto con la presa in consegna della merce da parte del vettore. La merce viaggia sempre - anche in caso di resa franco destino - a rischio e pericolo del committente. In caso di resa in porto franco sarà cura di Arte Mecano scegliere un corriere di sua fiducia, senza peraltro assumere alcuna responsabilità.
L’eventuale assicurazione per il trasporto dovrà essere esplicitamente richiesta dal Cliente e sarà effettuata a sue spese.
E’ obbligo del Cliente fare, al ricevimento dei prodotti, le opportune verifiche e, in caso di avaria o di anomalie, i necessari reclami scritti nei confronti del vettore prima di effettuare lo svincolo o di sciogliere la riserva posta al momento dell’accet- tazione del materiale. Anche se il prezzo fatturato dovesse intendersi per resa franco destino, restano comunque a carico del Cliente medesimo le eventuali spese extra dovute ad interruzione dei Servizi di trasporto o a soste eccezionali a stazioni causa eccessivi ingombri.

6. GARANZIA
Tutti gli apparecchi prima di essere spediti sono sottoposti a controlli rigorosi e sono garantiti immuni da difetti di materiali o di fabbricazione. Arte Mecano si impegna quindi a sostituire tutti gli apparecchi o componenti che entro un anno dalla data della fornitura presentano comprovati difetti di fabbricazione e purché gli stessi siano segnalati per iscritto nel periodo di validità.
La garanzia decade per gli apparecchi che risulteranno manomessi, o deteriorati per cause non imputabili alla Arte Mecano, nonché per gli apparecchi che verranno utilizzati per applicazioni in contrasto con i limiti di impiego dettati dalle norme e/o riportati sui cataloghi e/o sui documenti ufficiali di Arte Mecano. Poiché montaggio, lavori accessori, collegamenti elettrici e messa in servizio di apparecchi e impianti sono a carico del Cliente, la nostra garanzia è a copertura dei singoli apparecchi e non dell’impianto completo o del sistema, a meno che quest’ultimo non sia fornito chiavi in mano da Arte Mecano. Arte Mecano declina qualsiasi obbligo di risarcimento per danni diretti od indiretti o per utili mancati nel caso di contestazione di apparecchi o sistemi da lei forniti anche se gli stessi sono stati gratuitamente sostituiti o riparati.
7. RECLAMI
Per essere valido, ogni reclamo dev’essere formulato per iscritto ed indirizzato ad Arte Mecano tramite lettera raccomandata con ricevuta di ritorno entro 8 giorni dalla data di ricevimento della merce, pena la decadenza.
8. RESI
Il reso di apparecchi dovrà essere preventivamente con noi discusso e concordato. L’accettazione di un reso richiesto per cause non imputabili ad Arte Mecano è a nostro insindacabile giudizio e verrà effettuata solo se sussistono i seguenti pre- supposti e alle sottoelencate condizioni:
• Materiale gestito e di grande vendita
• Confezione in imballo originale
• Accredito all’8O% del prezzo di fattura
• Spese di resa relative a carico del Cliente.
Ricordiamo che eventuali colli non riportanti il talloncino Arte Mecano completo degli estremi di accettazione reso verranno respinti al mittente, con l’addebito di tutti gli oneri conseguenti.
9. RISERVATO DOMINIO
Arte Mecano si riserva il diritto di utilizzare la formula di “Riserva di Proprietà” sino all’integrale pagamento del prezzo median- te sottoscrizione di volta in volta degli appositi documenti.
Le spese si intendono integralmente a carico del Cliente.
10. RITARDI NEl PAGAMENTI E INTERESSI MORATORI
Nel caso di ritardo sui termini contrattuali convenuti dei pagamenti, verranno addebitati interessi bancari pari al tasso com- merciale medio corrente (6 punti oltre il “prime rate”) al momento della loro applicazione. Gli interessi moratori sono dovuti - in caso di ritardo - per il periodo intercorrente fra la scadenza contrattuale e la data dell’effettivo pagamento ai sensi dell’Arti.
1224 - 1282 C.C. Quanto sopra non conferisce tuttavia al Committente diritto alcuno a dilazionare il pagamento oltre alle Scadenze contrattuali. In caso di inadempimento e/o di prolungato ritardo e/o di elevata esposizione, Arte Mecano si riserva di intraprendere le azioni cautelative che riterrà più opportune. Nel caso di inadempimento dei pagamenti hanno effetto gli Art. 1460 - 1461 C.C. senza responsabilità alcuna di Arte Mecano.

6. GUARANTEE

7. CLAIMS
Far legitimate being, each claim must be communicated in writing and addressed to the ARTE MECANO srl through 8 days from the date of receipt of the good.
8. RHESUSES

The acceptance of a rhesus will come effected only to the followings conditions:
• materials still managed, conditions in original pack
• rebate to 80% of the price of execution
• costs load of the customer

9. RESERVE OF DOMINION
Arte Mecano reserves to use law formula of “reserve of ownership” up to the total payment of the price with undersigned appropriate contract. Costs are understood to total load of the customer.
10. DELAYS IN THE PAYMENTS AND AFFAIR OF BLACKBERRY
