CONDIZIONI GENERALI DI VENDITA

Le seguenti condizioni di vendita vengono integralmente accettate dall’acquirente con il conferimento dell’ordine.

ACCETTAZIONE

Ogni ordine è assunto "con riserva di accettazione" da parte di Casamilano.

PREZZI

La fornitura avviene sempre ai prezzi indicati nei listini di Casamilano ed alle condizioni in vigore alla data della conferma d’ordine.

VARIAZIONI DI ORDINI

Si accettano eventuali variazioni di ordini sino a 6 giorni dalla data della ns. conferma d’ordine. Variazioni di ordini contenenti finiture in legno e segnalate dopo 6 giorni dalla data della ns. conferma d’ordine, saranno soggette ad addebito pari al 30%

dell’importo dei prezzi da variare.

ANNULLO

L’annullamento dell’ordine confermato ha validità solo se accettato per iscritto dall’azienda la quale potrà richiedere un rimborso per le spese causate dall’annullamento.

TERMINI DI CONSEGNA

La fornitura avrà luogo con la massima sollecitudine, subordinatamente alla disponibilità di magazzino ed alla possibilità di produzione ed inoltro. Eventuali termini di consegna inseriti nella conferma d’ordine hanno valore semplicemente indicativo e non tassativo. I termini di consegna rimangono comunque sospesi per caso fortuito e per forza maggiore.

Ordini che comprendono più di un prodotto potranno essere spediti e fatturati parzialmente. La richiesta di spedizione unica potrà determinare l’applicazione del termine di consegna più lungo.

Le date di consegna riportate nelle nostre conferme d’ordine si riferiscono all’approntamento della merce presso la nostra sede, mentre la consegna viene effettuata la settimana successiva. Le richieste di consegne tassative dovranno essere concordate con l’azienda.

CONSEGNE - TRASPORTI

La merce si intende resa franco deposito dell’ordinante a cui spetta l’immediato conteggio dei colli, la verifica dello stato dell’imballaggio prima del ritiro, fare le dovute riserve allo spedizioniere e reclamare i danni nei termini di 7 giorni a mezzo e-mail.

Non si accetta alcuna responsabilità per consegne aventi destinazione diversa dal magazzino dell’ordinante.

Spese di dogana e tasse di importazioni tessuti/pelle cliente sono a totale carico dell’acquirente.

ESCLUSIONI SPECIALI

Non sono previste, tranne quelle indicate a listino con le relative maggiorazioni.

CAUTELE

Casamilano ha la facoltà di sospendere le forniture, quando le condizioni economiche dell’acquirente risultassero tali da porre in evidente pericolo il conseguimento del pagamento. Nel caso di pagamenti differiti, la mancata puntuale osservanza delle stabilite scadenze, legittima Casamilano a richiedere il versamento immediato dell’intero residuo prezzo.

PAGAMENTI

Modalità di pagamento e relativi termini sono precisati nella conferma d’ordine; il pagamento si intende a far data dalla ns. fattura.

L’eventuale accettazione di titoli di credito da parte di Casamilano avviene sempre salvo buon fine, senza novazione del rapporto sottostante e senza modifica del Foro competente. La non osservanza dei termini di pagamento comporta l’addebito degli interessi di mora. In caso di ritardo nel pagamento rispetto alla scadenza concordata, sarà stornato l’eventuale sconto cassa concesso e saranno applicati gli interessi di mora al tasso commerciale in vigore in Italia.

RECLAMI

Eventuali reclami di qualunque genere essi siano, dovranno essere segnalati per iscritto da parte del nostro cliente diretto entro 7 giorni dal ricevimento della merce. Reclami relativi a difetti e vizi di qualità palesi daranno origine alla riparazione o sostituzione del prodotto da noi giudicato difettoso. Si intende escluso ogni genere di indennizzo per spese o danni eventualmente collegati.

Si declina ogni responsabilità per ogni tipo di rivestimento eseguito con materiale fornito dal cliente.

PRODOTTI

Casamilano si riserva di apportare, senza l’obbligo del preavviso, miglioramenti estetici ai propri modelli, comprese modifiche nei materiali, nei rivestimenti, nelle finiture, nei disegni e nelle misure dei prodotti.

I disegni inseriti sul listino non definiscono i dettagli del prodotto; le misure riportate sono indicative e possono subire variazioni.

RESI

Non si accettano resi di merce se non espressamente autorizzati per iscritto e franco di ogni spesa al ns. magazzino, perfettamente imballati. Il cliente è responsabile del corretto imballaggio del prodotto reso. In caso di ulteriori danni arrecati al prodotto per insufficiente protezione dello stesso, Casamilano si riserverà di addebitare al Cliente le spese di riparazione.

Al fine di evitare contestazioni, Vi invitiamo pertanto a precisare sull’ ordine, se il tessuto dovrà essere confezionato in senso verticale, anziché in orizzontale (ns. standard). Questa lavorazione comporterà una maggiorazione sul costo della confezione ed in alcuni casi l’aumento del metraggio di tessuto necessario, dovuto alle cuciture e alla maggiore quantità di tessuto occorrente per il confezionamento.

Pelli all’anilina: la naturalità del prodotto di rivestimento in pelle può mettere in evidenza alcune caratteristiche del prodotto stesso:

sulla superficie esterna possono essere evidenti segni caratteristici della vita dell’animale (rughe, cicatrici, porosità, differenze di grana, ecc.) che non sono da considerare difetti, ma garanzia della naturalità del prodotto acquistato. Per quanto possibile, le parti di rivestimento provviste di tali caratteristiche vengono opportunamente posizionate in parti non in vista del prodotto.

Sconsigliamo di esporre il rivestimento in pelle alla luce solare diretta e a fonti di illuminazione diretta (fari, faretti spot) di grande intensità. Evitare il contatto diretto del rivestimento con parti metalliche, appuntite o altro, in quanto potrebbero causare graffi o abrasioni irrimediabili.

- Tessuti cliente:

ATTENZIONE !

Casamilano si riserva di applicare, al momento della lavorazione, eventuali maggiorazioni al costo della confezione, oppure richiedere un aumento del metraggio di tessuto occorrente, per quei tessuti clienti che richiedono lavorazioni speciali, dovute alla tipologia del tessuto stesso.

i tessuti di proprietà dei clienti che saranno inviati per la ricopertura dei nostri modelli, dovranno pervenirci in porto franco, in caso contrario saranno addebitate le spese di trasporto. Gli stessi dovranno essere accompagnati da una copia della conferma d’ordine o dovrà comunque essere citato il riferimento dell’ordine.

- Dimensioni:

Le dimensioni relative a parti imbottite sono soggette alle tolleranze d’uso nel tempo determinate dal normale assestamento delle imbottiture.

Le dimensioni espresse in inches sono state arrotondate per eccesso.

INFORMAZIONI

Il presente listino annulla e sostituisce tutti i precedenti.

IMBALLO IN GABBIE DI LEGNO

Per eventuali consegne di merce in gabbia di legno, sarà applicato un costo pari al 10% sul prezzo di listino del prodotto.

PROPRIETÀ DELLA MERCE

La proprietaria della merce rimane Casamilano finchè tutte le fatture non sono state completamente pagate.

MARCHI

L’acquirente di prodotti di Casamilano che proceda alla loro rivendita è tenuto a rispettare la presentazione originale dei prodotti senza possibilità di sopprimere i marchi di fabbrica.

DEROGHE

Le condizioni generali operano in ogni caso, ove non risultino derogate, espressamente e per atto scritto di Casamilano.

FORO

Per ogni ed eventuale controversia, il foro di Milano e’ competente.

GENERAL SALES CONDITIONS

Public prices, Euro, free of charge to the address of our retailer, except for islands (for Europe). Ex Factory ( Rest of the Word) The following sales conditions are fully accepted by the customer when placing the order.

ACCEPTANCE

Casamilano reserves the right to accept the order or not.

PRICES

All orders are purchased with the prices stated on the Casamilano price lists and at the conditions in force when issuing the order confirmation.

ORDER CHANGES

Casamilano accepts order changes until 6 days after the date of the order confirmation. Every change of orders containing wood products and notified more than 6 days after the date of our order confirmation, will be subject to a charge of 30% of the changing prices.

CANCELLATION

The cancellation of a confirmed order is valid only if it is accepted in writing by Casamilano; in this case Casamilano has the right to require the reimbursement of all expenses due to cancellation.

DELIVERY CONDITIONS

The goods will be consigned at the earliest convenience, depending on the availability of the products at stock and on the possibility of producing them. The delivery dates stated on the order confirmations are only approximate and not binding.

In any case, delivery is suspended in case of Acts of God.

Orders that contain more than one product can be partially invoiced and delivered.

The request for a single delivery of all products will force us to wait until all products are ready and to apply a longer delivery time.

Delivery times stated on our order confirmations refer to the preparation of the goods in our warehouse, while consignment to the customer is made the following week.

All requests for specific delivery dates will have to be agreed upon in advance with Casamilano.

CONSIGNMENTS - TRANSPORT

The goods will be consigned free of charge to the address of our customer, who is responsible for soon calculating the number of packages, for checking the condition of the packages before accepting them, for notifying any deficiency to the forwarding agent and for claiming the damages within 7 days by email.

Casamilano does not accept any responsibility for deliveries to addresses which are different from the address of the warehouse of the customer.

All customs duties and taxes arising from the import of customer’s fabrics or customer’s leather are at our customer’s charge.

SPECIAL EXCLUSIONS

Casamilano does not provide for any exclusion, exception made for those stated on the price list with the relevant surcharges.

PRECAUTIONS

Casamilano has the right to suspend consignments when the financial situation of the customer is of evident risk and could hamper payments.

In case of deferred payments, if the customer does not pay on time, Casamilano has the right to require the prompt payment of the whole remaining amount.

PAYMENTS

Payments terms and relevant expiry date are stated on the order confirmation; the expiration is calculated starting from the date of our invoice.

Casamilano accepts documents of credit subject to collection, without novation of the relationship and without changing the place of jurisdiction.

If the payment terms are not honoured, the interests on delayed payment will be charged.

In case of delayed payment, settlement discounts will not be accepted and the customer will be charged with the current Italian interest rate.

COMPLAINTS

Every kind of complaint should be notified in writing within 7 days from receipt of the goods by our customer.

All complaints referring to evident damages or quality flaws will be solved by repairing or replacing the damaged item.

Casamilano will not take the responsibility for any reimbursement of expenses or damages linked to a complaint.

Casamilano will not take the responsibility for any type of covers made of fabric or leather or any other material sent by the customer.

PRODUCTS

Casamilano reserves the right to improve its models in aesthetics, including variations in materials, covers, finishes, designs and sizes, without prior notice.

The drawings reproduced on the price list do not refer to the details of the products; the dimensions on the price list are only approximate and can be subject to variations.

RETURNED GOODS

Casamilano does not accept returning goods except if agreed upon in advance in writing; in any case goods must be returned

The colours of sample books, fabrics, leathers, woods and lacquers, stones and marble are approximate and not binding.

When confirming the order the buyer accepts any possible differences in colour and grain.

Fabric requirements as indicated on the price list are for plain colour fabrics 140 cm. wide.

For fabrics with drawings, stripes, flowers please add 40% more of fabric, to the lmtr. Indicated.

Fabrics must be washed according to the instructions written on our pattern book.

In case of product to be covered with more fabrics of a different category, please apply the price of the higher category of fabric.

To avoid stitches on large sofas and armchairs, please remember that Casamilano (by architects’ choice) has always upholstered its furniture by cutting the fabrics horizontally except for striped and flowered fabrics.

In order to prevent disputes, we consequently invite you to indicate on the order whether the fabric has to be cut vertically, instead of horizontally (our standard) with texture and fur.

This solution involves an extra charge for the production and sometimes an increase in the length of the fabric required, due to the stitches and the larger amount of fabric needed for manufacture.

WARNING !

Casamilano reserves the right to apply, at time of manufacture, possibly increases in the cost of textile confection, or may ask for an increase in the quantity of fabric needed, for those clients’ fabrics that request a special processing, due to the type of fabric itself

C.O.M. must be sent to Casamilano free of charge, otherwise Casamilano will charge the customer with the delivery charges.

The fabrics must be sent together with a copy of the order confirmation and in any case the customer must write the order confirmation number or reference on the delivery note.

Aniline leather: On leather covers there may be evident signs that are characteristic of the animal’s life (wrinkles, scars, porosity, grain differences, etc.), which should not be considered as defects, but a guarantee of the genuineness of the product. Leather covers with these characteristics are used as much as possible in parts of the product where they are not visible. We strongly recommend not to expose the products to direct sunlight or direct sources of high intensity lighting (lamps, spot lights, etc). Avoid direct contact of the cover with metal or sharp items or other similar articles as they could cause irreparable scratches or abrasions.

- Dimensions:

Dimensions of padded products or parts can be subject to changes due to usage, caused by the usual adjustment of the padding.

The dimensions expressed in INCHES have been rounded up.

INFORMATION

This price list cancels and replaces the previous one.

All terms and conditions are fully accepted by the customer when placing the order.

WOODEN CRATES

In case wooden crates are required for a delivery, there will be a surcharge of 10% on the list price of the product.

GOODS PROPERTY

Goods belong to Casamilano, until all the invoices are fully paid.

TRADEMARKS

The buyer of Casamilano products who resells them must comply with the original presentation of the products without possibility of taking off the trademarks.

DEROGATIONS

The general terms work in any case, where they are not derogated expressly and in writing by Casamilano.

PLACE OF JURISDICTION

For all disputes the place of jurisdiction is Milan.

CONDITIONS GÉNÉRALES DE VENTE

ACCEPTATION

Chaque commande est reçue "sous réserve d’acceptation" de la part de Casamilano.

PRIX

Les prix se réfèrent aux prix précisés dans les tarifs de Casamilano et aux conditions en vigueur au moment de la confirmation de commande.

VARIATIONS DES COMMANDES

Il n’est possible de varier les commandes que jusqu’à 6 jours avant notre date de confirmation de commande. Dans le cas de variations de commandes qui prévoient des changements au niveau de la finition en bois et reçues 6 jours après la date de notre confirmation de commande, il est à prévoir une perception supplémentaire de 30% sur le montant des pièces à modifier.

ANNULATION

L’annulation de la commande confirmée n’est valable que si elle est acceptée par écrit par Casamilano, qui pourra demander un remboursement pour les frais causées par l’annulation.

TERMES DE LIVRAISON

La commande va être expédiée le plu tôt possible, sur la base du stock disponible et de la possibilité de production et expédition immédiate. Les termes de livraison précisés sur la confirmation de commande ne sont qu’indicatifs. Il faut aussi considérer qu’il est aussi possible de suspendre une expédition de commande en cas de force majeure. Les commandes relatives à plus d’un produit peuvent être expédiées et facturées partiellement.

La demande de livraison d’une seule expédition peut déterminer l’application d’un terme de livraison plus long.

Les dates de livraison indiquées dans nos confirmations de commande ne sont données qu’à titre indicatif départ usine. Les demandes de livraisons péremptoires devront être fixées d’un commun accord avec Casamilano.

LIVRAISON - TRANSPORT

Les prix nets se réfèrent à la marchandise rendue franco dépôt du destinataire.

Il est au destinataire de vérifier le numéro de colis et les conditions de la marchandise au moment de la livraison et de faire d’éventuelles réserves au transporteur dans les 7 jours après par e-mail. Aucune responsabilité dans le cas de livraison à destination différente n’est acceptée.

Les taxes douanières et d’importation pour tissu/cuir client sont à la charge de l’acheteur.

EXCLUSIONS SPECIALES

Aucune exclusion spéciale n’est prévue, à l’exception de ce qui est bien précisé dans le tarif, y compris les augmentations de prix relatives.

PRECAUTIONS

Casamilano a la faculté de suspendre immédiatement toute commande, lorsque les conditions économiques de l’acheteur menacent sérieusement le paiement.

En cas de paiement différé, si les échéances agrées ne sont pas respectées, Casamilano peut demander immédiatement le paiement résiduel.

PAIEMENTS

Les modes de paiements et les termes sont bien précisés sur la confirmation de commande. L’échéance du paiement est à compter à partir de la date de notre facture. Une possible acception de titres de crédit de la part de Casamilano est toujours sauf bon fin, sans renouvellement du rapport et notification immédiate au Tribunal compétent.

Si les termes ne sont pas respectés, débit immédiat des intérêts de retard.

Tout retard de paiement par rapport à l’échéance fixée entraînera l’annulation des remises accordées et l’application des intérêts de retard, calculés au taux commercial en vigueur en Italie.

RECLAMATIONS

Les possibles réclamations, de tout genre, doivent nous parvenir par écrit de la part du client dans les 7 jours suite à la réception de la marchandise.

En cas de réclamations relatives aux défauts de qualité visibles, il est à nous de réparer ou remplacer immédiatement la marchandise défectueuse.

Il est exclu tout dédommagement en cas de frais ou dommages reliés.

Nous nous dégageons toute responsabilité dans le cas du tissu client.

PRODUITS

Casamilano se réserve le droit d’apporter toute amélioration esthétique à ses modèles, y compris toute modification des matériaux, finitions, designs et dimensions des produits, sans aucun préavis obligatoire.

Les dessins contenus dans le tarif ne définissent pas les détails de l’article; les dimensions sont seulement indicatives et peuvent être modifiées.

Les coloris des tissus - cuirs - bois - laques, pierres et marbre ne sont qu’indicatifs.

A la confirmation de sa commande, le client accepte toutes les possibles tolérances de coloris et veinures Les métrages indiqués sur ce tarif concernant les tissus teinte unie - hauteur 140 cm.

Pour les tissus avec dessins, rayures, fleurs ajutez le 40% de tissu en plus au métrage indiqué.

Laver les tissus selon les instructions indiquées dans la collection d’échantillons.

Pour les produits avec housse en plusieurs catégories de tissu, appliquer le prix de la catégorie supérieure.

Pour éviter les coutures sur les canapés et les fauteuils de grandes dimensions, nous vous rappelons que, depuis toujours, Casamilano (par le choix des architectes) confectionne les revêtements de ses produits en coupant les tissus dans le sens horizontal à l’exception des tissus rayés et à fleurs avec texture et fourrure.

Afin d’éviter toute contestation, nous vous invitons donc à préciser sur le bon de commande, si le tissu doit être confectionné dans le sens vertical, plutôt que dans le sens horizontal (notre standard).

Cette exécution entraînera une majoration du prix de la confection et, dans certains cas, l’augmentation du métrage de tissu nécessaire, due aux coutures et à la plus grande quantité de tissu qu’il faudra utiliser pour la confection.

Les tissus fournis par les clients qui seront envoyés pour le revêtement de nos produits, devront nous parvenir franco usine, dans le cas contraire les frais de transport seront mis en compte.

ATTENTION !

Casamilano se réserve le droit d’appliquer, au moment de la fabrication, éventuellement une augmentation du coût de la confection, ou demander une augmentation de la quantité du tissu nécessaire, pour les tissus clients qui ont besoin d’un traitement spécial, en raison du type de tissu même.

Les tissus devront être accompagnés de notre confirmation de commande; en toute cas le client devra indiquer le numéro de confirmation ou la référence de la commande sur le bon de livraison.

Cuir à l’aniline: la naturalité du produit revêtu en cuir peut mettre en évidence certaines caractéristiques du produit lui-même ; sur la surface extérieure peuvent être évidents des signes caractéristiques de la vie de l’ animale (rides, cicatrices, porosité, différences de textures, etc.) qui ne doivent pas être considérés comme des défauts, mais l’assurance de la naturalité du produit.

Dans la mesure du possible, les parties de revêtement munis de telles caractéristiques sont correctement positionnés dans les parties non en vue du produit. Nous recommandons de ne pas exposer le cuir à la lumière directe et aux sources d’éclairage (éclairage, projecteurs) d’une grande intensité. Éviter le contact direct de la housse avec des parties en métal ou pointus ou autrement, car ils peuvent causer des rayures ou abrasions irréparables.

- Dimensions:

Les dimensions des produits rembourrés peuvent se modifier dans le temps à la suite de leur usage et de leur stabilisation.

Les dimensions exprimées en " INCHES " ont été arrondies par excès.

INFORMATIONS

Ce tarif annule et remplace tous les précédents.

EMBALLAGE DANS CAGES EN BOIS

Pour l’éventuelle livraison de produits emballés dans cages en bois, Casamilano débitera un total de 10% du prix de tarif du produit.

PROPRIÉTÉ DES MARCHANDISES

La marchandise reste de propriété de Casamilano jusqu’à la réception du montant globale de la facture.

MARQUES

L’acheteur des produits Casamilano qui va les revendre doit respecter l’emballage et la présentation originale des produits, sans aucune possibilité de supprimer la marque.

DEROGATIONS

Ces conditions générales sont toujours valables sauf si expressément dérogées par écrit de la part de Casamilano.

TRIBUNAL

Pour toute contestation, attribution est faite au Tribunal dé Milan.

ALLGEMEINE VERKAUFSBEDINGUNGEN

Verkaufspreise - Euro - frei Haus, ausschließlich Inseln (für Europa). Ab-Werk (Rest der Welt).

Bei der Erteilung einer Bestellung akzeptiert vollständig der Käufer die folgenden Verkaufsbedingungen.

ANNAHME

Jede Bestellung wird unter "Vorbehalt" von Casamilano akzeptiert.

PREISE

Die Lieferung erfolgt immer laut der in den Casamilano Preislisten genannten Preise und unter den Bedingungen, die unter dem Auftragsbestätigungsdatum in Kraft sind.

BESTELLUNGSÄNDERUNGEN

Eventuelle Bestellungsänderungen werden innerhalb 6 Tagen ab Auftragsbestätigungsdatum akzeptiert.

Für Bestellungsänderungen bezüglich Holzausführungen - und die nach 6 Tagen ab unserer Auftragsbestätigungsdatum mitgeteilt werden - werden wir 30% der betreffenden Preisbetrag berechnen.

STORNIERUNG

Die Stornierung von bestätigten Aufträgen ist nur gültig, wenn sie von Casamilano schriftlich genehmigt wird.

Casamilano behält sich vor, eventuelle Kosten in Rechnung zu stellen.

LIEFERZEIT

Mit größter Eile werden die Lieferungen erfolgen, abhängig von dem Lagervorrat und von der Produktion -und Lieferungsfähigkeit.

Die auf der Auftragsbestätigung genannten Liefertermine sind nur Richttermine und sind nicht verbindlich.

Im Fall von Zufall oder höhere Gewalt sind die Liefertermine nicht mehr gültig.

Bestellungen von verschiedenen Produkten werden teilweise geliefert und angerechnet können.

Für Einzellieferungen kann die Lieferzeit länger sein.

Die Liefertermine auf unseren Auftragsbestätigungen gelten nur als Richtlinie ab Werk.

Die Lieferung an den Kunden erfolgt während der folgenden Woche.

Feste Liefertermine müssen mit der Firma ausdrücklich vereinbart werden.

LIEFERUNGEN - TRANSPORTE

Die Lieferung erfolgt frei Haus. Der Käufer soll die Kollis zählen, vor der Annahme den Zustand der Verpackungen überprüfen, alle Beanstandungen dem Spediteur bei der Warenannahme mitteilen oder weitere Schaden innerhalb 7 Tagen per e-mail mitteilen.Mit Bezug auf die Lieferungen, die nicht an den Lager des Käufers adressiert sind, übernimmt Casamilano keine Verantwortung. Grenzzölle und Einfuhrzölle für Kundenstoffe und Kundenleder gehen zu Lasten des Käufers.

BESONDERE AUSSCHLÜSSE

Keinen Ausschluss ist vorgesehen, außer denjenigen, die auf der Preisliste mit den betreffenden Preiserhöhungen genannt sind.

VORSICHT

Keine Lieferung erfolgt, im Fall dass der Käufer finanzielle Schwierigkeiten hat.

Im Fall von verschobenen Zahlungen kann Casamilano nach die sofortige Überweisung des Restbetrags fragen, wenn die vereinbarten Fälligkeiten nicht eingehalten sind.

BEZAHLUNGEN

Zahlungsbedingungen und -termine sind auf der Auftragsbestätigung bekannt gegeben. Zahlungsbedingung versteht sich ab Rechnungsdatum.

Eventuelle Annahme seitens Casamilano von Schuldscheine erfolgt immer unter üblichem Vorbehalt, ohne Novation der Handelsbeziehung und ohne das zuständige Gericht zu wechseln.

Bei Überschreitung des Zahlungstermins wird der etwaig gewährte Kassaskonto storniert, bzw. werden die Verzugszinsen zum gültigen handelsüblichen italienischen Zinssatz berechnet.

REKLAMATIONEN

Jede Reklamation von Seiten des direkten Kunden muss innerhalb 8 Tagen nach dem Erhalt der Ware schriftlich mitgeteilt werden.

Reklamationen abhängig von offensichtlichen Qualitätsfehler und -mängel werden mit der Reparatur oder mit dem Ersatz des Produktes gelöst, das von uns als defekt anerkannt wird.

Casamilano übernimmt keine Verantwortung für die bezüglichen Kosten oder die Beschädigungen.

Für Bezüge aus vom Kunden geliefertem Material kann keinerlei Verantwortung übernommen werden.

PRODUKTE

Casamilano behält sich das Recht vor, ohne Vorwarnung die Modelle ästhetisch zu verbessern; mitbegriffen sind auch Materialien, Bezüge, Ausführungen, Designs und Maße der Produkte.

Die Zeichnungen auf der Preisliste beschreiben keine Produktdetails; die angegebene Maße können jederzeit geändert werden.

RETOURWARE

Retourware wird ausschließlich aufgrund einer vorherigen schriftlichen Vereinbarung mit Casamilano, frei Haus bis zu unserem Lager und mit perfekter Verpackung akzeptiert.

Der Kunde ist verpflichtet, die Ware sorgfältig zu verpacken.

Die Reparatur der eventuellen Schäden wegen ungenügender Verpackung wird in Rechnung gestellt.

Ausgenommen hiervon sind gestreifte und geblümte Stoffe mit Textures und Plüsch.

Zur Vermeidung von Beschwerden bitten wir Sie deshalb auf Ihrer Bestellung anzugeben, ob der Stoff vertikal oder horizontal (unser Standard) geschnitten werden soll.

Die Verarbeitung mit vertikalem Schnitt erfordert einen Kostenaufschlag auf die Anfertigung und in einigen Fällen erhöht sich auch den Stoffbedarf.

ACHTUNG!

Im Moment der Wareanfertigung behält sich Casamilano das Recht vor, eventuelle Erhöhungen der Kosten oder eine Erhöhung der erforderlichen Stoffmetrage anzuwenden: Das wegen einiger Kundenstoffe, die eine spezielle Verarbei- tung erfordern.

Kundenstoffe müssen frei Haus an Casamilano geliefert werden, sonst wird Casamilano Ihnen mit den bezüglichen Lieferkosten belasten.

Bitte auf den Lieferschein immer die Auftragsbestätigungsnummer oder die Auftragskommission angeben.

Anilinleder: die Natürlichkeit des Lederbezugs kann einige Kennzeichen des Produkts unterstreiten: Auf der außen Oberfläche können besondere Kennzeichen des Tierlebens (Falten, Narben, Porosität, Kornunterschiede usw.) sichtbar sein. Diese sollen nicht als Defekte berechnet werden, sondern sie sind Garantie der Natürlichkeit vom gekauften Produkt. Wenn möglich, werden diese Teile in unsichtbaren Punkten genäht.

Wir empfehlen nicht, Lederbezüge unter direktes Sonnenlicht oder unter andere direkte Lichtquellen (Scheinwerfer, Spotscheinwerfer) auszustellen. Direkten Kontakt des Bezugs mit Metallteilen, spitzen Teilen usw. vermeiden, denn diese könnten unersetzliche Kratzer und Schürfwunden verursachen.

- Maße:

Wegen normaler Polsterungsregelung und wegen des Gebrauchs sind Abweichungen von Maßen vorgesehen.

Die in "INCHES" angegebenen Abmessungen wurden nach oben abgerundet.

INFORMATIONEN

Diese Preisliste streicht und ersetzt alle die vorigen.

VERPACKUNG IN HOLZKISTEN

Für die Verpackung eines Produkts in Holzkisten wird Casamilano den Kunden mit 10% des Listenpreises belasten.

EIGENTUNM RECHT

Die Ware verbleibt im besitzt der Firma Casamilano bis die entsprechenden Rechnungen vollständing bezahlt sind.

HANDELSMARKE

Der Wiederverkäufer von Casamilano Produkten muss die originelle Vorstellung der Produkte darstellen, ohne die Handelsmarke aufzuheben.

AUSNAHMEN

Diese allgemeinen Verkaufsbedingungen sind auf jeden Fall gültig - wenn nicht schriftlich von Casamilano derogiert.

GERICHTSSTAND

Der Gerichtsstand für sämtliche Streitigkeiten ist das Amtsgericht in Milano.
