CLASSIFICARE I TIPI DI DEMOCRAZIA
Le democrazie possono essere classificate in tre tipi:
1. Presidenziale 2. Parlamentare
3. Semi-presidenziale / Mista
Se una democrazia è parlamentare, presidenziale o mista dipende dal rapporto tra:
A. Governo
B. Assemblea legislativa
C. Presidente (se ce n’è uno)
DUE DOMANDE PER LA
CLASSIFICAZIONE:
1. IL GOVERNO È RESPONSABILE DI
FRONTE ALL’ASSEMBLEA LEGISLATIVA?
Se non lo è, allora la democrazia è presidenziale
Se lo è, allora la democrazia è parlamentare o mista
Per responsabilità s’intende la possibilità di rimuovere il governo in carica senza causa specifica
Esempio: voto di sfiducia
FIDUCIA, SFIDUCIA E SFIDUCIA COSTRUTTIVA
Una mozione di sfiducia è proposta dal legislativo; se il governo non ottiene una maggioranza legislativa in questo voto, deve rassegnare le dimissioni
Un voto di sfiducia costruttivo deve indicare chi sostituirà il governo in carica, una volta perso il voto di sfiducia
Un voto di fiducia è proposto dal governo; se il governo non ottiene la maggioranza legislativa in questo voto, deve
rassegnare le dimissioni

2. C’È UN PRESIDENTE ELETTO PER UN PERIODO PRESTABILITO?
Se c’è un capo di stato non eletto e siamo in democrazia, allora il regime è parlamentare (monarchia parlamentare)
Se non c’è un presidente, allora il regime è parlamentare
Se c’è un presidente eletto – direttamente o indirettamente – è
condizione necessaria ma non sufficiente perché il regime sia
misto: deve esistere responsabilità presidenziale (possibilità di
sciogliere le camere o licenziare il governo)
RIASSUMENDO:
Una democrazia presidenziale è quella in cui la sopravvivenza del governo non dipende da una maggioranza legislativa
Una democrazia parlamentare è quella in cui la sopravvivenza del governo dipende solo da una maggioranza legislativa
Una democrazia semipresidenziale è quella in cui la
sopravvivenza del governo dipende da una maggioranza
legislativa e da un presidente eletto in modo indipendente

IRISH CONSTITUTION 1937:
PARLIAMENTARY, PRESIDENTIAL, SEMIPRESIDENTIAL?
Article 12: There shall be a President of Ireland (Uachtarán na hÉireann), hereinafter called the President, who shall take precedence over all other persons in the State and who shall exercise and perform the powers and functions conferred on the President by this Constitution and by law. The President shall be elected by direct vote of the people.
Article 13: The President shall, on the nomination of the Low Chamber, appoint the Taoiseach, that is, the head of the Government or Prime Minister. The president shall, on the nomination of the Taoiseach with the previous
approval of the Low Chamber, appoint the other members of the Government. The President shall, on the advice of the Taoiseach, accept the resignation or terminate the appointment of any member of the Government. The Low Chamber shall be summoned and dissolved by the President on the advice of the Taoiseach. The President may in his absolute discretion refuse to dissolve the Low Chamber on the advice of a Taoiseach who has ceased to retain the support of a majority in the Low Chamber. . . . The President shall not be answerable to either House of the Parliament or to any court for the exercise and performance of the powers and functions of his office or for any act done or purporting to be done by him in the exercise and performance of these powers and functions.
Article 15: The National Parliament shall be called and known, and is in this Constitution generally referred to, as the Oireachtas. The Oireachtas shall consist of two Houses, viz.: a House of Representatives to be called Dáil Éireann and a Senate to be called Seanad Éireann.
Article 28: The Government shall consist of not less than seven and not more than fifteen members who shall be appointed by the President in accordance with the provisions of this Constitution. . . . The Government shall be responsible to the Dáil Éireann. The head of the government, or Prime Minister, shall be called, and is in this Constitution referred to as, the Taoiseach.
