Decisione di esecuzione (UE) 2018/593 del Consiglio del 16 aprile 2018 che
autorizza la Repubblica italiana a introdurre una misura speciale di deroga agli articoli 218 e 232 della direttiva 2006/112/CE relativa al sistema comune Iva
• La deroga si applica dal 1° luglio 2018 al 31 dicembre 2021
• Qualora ritenesse necessaria la proroga della deroga,
congiuntamente alla domanda di proroga l'Italia dovrà presentare alla Commissione una relazione in grado di evidenziare che le
misure nazionali adottate sono risultate efficaci ai fini della lotta alla frode e all'evasione dell'IVA e della semplificazione della
riscossione delle imposte

• L’obbligo riguarda la cessioni di beni e le prestazioni di servizi effettuate tra soggetti residenti, stabiliti o identificati nel territorio dello Stato
• Le fatture elettroniche devono essere emesse esclusivamente tramite il SdI
• Gli operatori economici possono avvalersi di intermediari, ferme restando le responsabilità del soggetto che effettua la cessione del bene o la prestazione del servizio
• Sono esonerati i soggetti passivi che rientrano nel "regime di vantaggio" (art. 27, commi 1 e 2, del decreto-legge 6 luglio 2011, n. 98) e quelli che applicano il regime forfettario (art. 1, commi da 54 a 89, della legge 23 dicembre 2014, n. 190)
• Comunicazione dei dati delle fatture emesse e ricevute (i.e. spesometro) con riguardo alle operazioni
di cessioni di beni e prestazioni di servizi effettuate e ricevute verso e da soggetti non stabiliti nel
territorio dello Stato (salvo quelle con bolletta doganale o emissione/ricezione di fattura elettronica)

• In caso di emissione di fattura utilizzando modalità diverse dal SdI, la fattura si intende non emessa e si applicano le sanzioni previste dall'articolo 6 del decreto legislativo 471/97
• Il cessionario e il committente, per non incorrere nella sanzione di cui all'articolo 6, comma 8, del decreto legislativo 471/97, devono adempiere agli obblighi
documentali ivi previsti mediante il Sistema di Interscambio
• Gli obblighi di conservazione previsti dall'articolo 3 del DMEF 17 giugno 2014, si
intendono soddisfatti per tutte le fatture elettroniche trasmesse attraverso il Sistema
di Interscambio e memorizzati dall'Agenzia delle Entrate

• L’obbligo di fatturazione elettronica B2B/B2C tramite SdI si applica alle fatture emesse a partire dal 1º gennaio 2019, e dalla medesima data l'articolo 21 del decreto-legge 31 maggio 2010, n. 78 è abrogato
• L’obbligo di fatturazione elettronica viene anticipato al 1º luglio 2018 per:
a) cessioni di benzina o di gasolio destinati ad essere utilizzati come carburanti per motori;
b) prestazioni rese da soggetti subappaltatori e subcontraenti della filiera delle imprese nel quadro di un contratto di appalto di lavori, servizi o forniture
stipulato con una PA, rilevando che per filiera delle imprese si intende l'insieme
dei soggetti, destinatari della normativa di cui all'articolo 3 della legge 13 agosto
2010, n. 136

• Il termine di decadenza IVA e IIDD sono ridotti di due anni se viene garantita la tracciabilità dei pagamenti ricevuti ed effettuati relativi ad operazioni di
ammontare superiore ad euro 500
• Agli esercenti arti e professioni ed alle imprese ammesse al regime di contabilità semplificata, l'Agenzia delle entrate mette a disposizione:
a) gli elementi informativi necessari per la predisposizione dei prospetti di liquidazione periodica dell'IVA;
b) una bozza di dichiarazione annuale dell'IVA e di dichiarazione dei redditi, con i relativi prospetti riepilogativi dei calcoli effettuati;
c) le bozze dei modelli F24 di versamento recanti gli ammontari delle imposte da versare, compensare o richiedere a rimborso.
• Se i suddetti soggetti si avvalgono degli elementi messi a disposizione
dall'Agenzia delle entrate, viene meno l'obbligo di tenuta dei registri IVA acquisti

• Servizio di registrazione tramite il quale il cessionario/committente (o intermediario art.3 c.3 DPR 322/98) può indicare al SdI il canale (WS, FTP, PEC) e l’indirizzo telematico
preferito per la ricezione dei file ( indirizzo PEC o Codice destinatario)
• In caso di registrazione al SdI, le fatture elettroniche sono sempre recapitate all’indirizzo telematico registrato, diversamente la veicolazione della fattura al destinatario verrà eseguita :
1. tramite il canale WS/FTP se compilato il campo <CodiceDestinatario>
2. tramite PEC se compilato il campo <PECDestinatario>
• La trasmissione al SdI della fattura elettronica può essere eseguita tramite i canali PEC (30 MB), Web Service (5MB), FTP (150 MB), procedura WEB servizio «Fatture e
corrispettivi» (5 MB), APP (iOS ed Android)
• La ricezione dal SdI della fattura elettronica può essere eseguita tramite i canali PEC, Web Service, FTP
• Per la regolarizzazione operazioni art.6 c.8 del D.Lgs 471/97: si dovrà trasmettere

• Consumatore finale: inserimento del solo codice convenzionale “0000000“ nel caso in cui non siano stati compilati i campi <IdFiscaleIVA> e sia compilato solo il campo <CodiceFiscale> del cessionario/committente, ed il SdI metterà a disposizione l’originale della fattura elettronica nell’area riservata del sito dell’Ag. Entrate, mentre il
cedente/prestatore dovrà consegnare una copia informatica o analogica della fattura
• Regime di vantaggio, forfettario e produttori agricoli: inserimento del solo codice convenzionale “0000000“ed il SdI metterà a disposizione l’originale della fattura elettronica nell’area riservata del sito dell’Ag. Entrate ed il
cedente/prestatore dovrà comunicare tempestivamente (con modi diversi dal SdI) che l’originale della fattura elettronica è a sua disposizione (tale comunicazione può essere effettuata anche con consegna copia informatica o cartacea della fattura)
• Mancata comunicazione del codice destinatario o indirizzo PEC: inserimento del solo codice convenzionale “ 0000000“ed il SdI metterà a disposizione l’originale della fattura elettronica nell’area riservata del sito dell’Ag.

cedente/prestatore dovrà comunicare tempestivamente (con modi diversi dal SdI) che l’originale della fattura
elettronica è a sua disposizione (tale comunicazione può essere effettuata anche con consegna copia informatica o
cartacea della fattura)
