Le seguenti condizioni generali di vendita fanno parte integrante di tutti i nostri contratti di fornitura di materiali, anche quando gli ordini vengono assunti telefonicamente, verbalmente, a mezzo fax, e-mail o a mezzo internet. MAGGIO S.r.l., vende in Italia e all’estero macchine, attrezzature e servizi di tipo professionale per uso agricolo. La società ha sede a Rutigliano (BA) alla S.P. 24O delle Grotte Orientali- Km. 13,800, Codice Fiscale / Partita Iva 07909210721, Registro delle imprese n.07909210721, Numero di Iscrizione al Tribunale di Bari Reg.

Soc.n.590807, CCIIA Di Bari n.79243.

1. CLIENTI: Maggio S.r.l. produce, fabbrica e commercializza in Italia i prodotti a marchio Maggio S.r.l. rivolgendosi esclusivamente ad una clientela professionale. Il cliente assicura che l´acquisto dei prodotti Maggio S.r.l. avviene a fini esclusivamente professionali, vale a dire attinenti alla propria attività lavorativa. Il rapporto tra Maggio S.r.l. e i clienti non sarà pertanto disciplinato dalle normative a tutela dei consumatori, tra cui in particolare il D.lg.

185/1999(contratti conclusi a distanza), D.lgs. n.50/1992 (diritto di recesso), d.lgsn.24/2002, l. 126/1991 e artt. 1469 e ss. del c.c..

2. PREZZI: I prezzi del listino Maggio S.r.l. sono espressi in Euro (€), s´intendono per pezzo e non sono comprensivi di IVA.I prezzi non comprendono le spese di spedizione e il contributo fisso, calcolato in via forfettaria, pari a €4,20, salvo diversi accordi tra le parti.

3. RICHIESTA DI PREVENTIVO: Eventuali richieste di preventivo, inoltrate tramite fax, richiesta telefonica, verbale e quant’altro non rappresentano in nessun caso “ordine esecutivo di vendita”. A seguito di tali richieste la società si attiverà esclusivamente al fine di fornire le informazioni oggetto delle richieste medesime.

4. PROPOSTA DÓRDINE: I clienti della ditta Maggio S.r.l. già in possesso dellápposito codice cliente e che abbiano stipulato con Maggio S.r.l. specifici accordi in tal senso, potranno inviare proposte dórdine tramite l’opportuno modulo prestampato. Tali proposte, non rappresentano in alcun modo acquisto in quanto trattasi di semplici proposte il cui perfezionamento è subordinato alla accettazione conforme di Maggio S.r.l..

5. PAGAMENTO: Per pagamento ritardato oltre i termini previsti dalla fattura verranno adde- bitati gli interessi nella misura pari agli interessi legali maggiorati di tre punti e relative spese.

6. FATTURE: Eventuali reclami o contestazioni su fatture saranno accettati a condizione che pervengano alla sede Maggio S.r.l. o ai vari punti vendita a mezzo lettera, fax o e-mail entro otto giorni dalla data di ricezione della fattura stessa.

7. RESI: Le seguenti disposizioni in materia di Resi saranno applicate in due differenti casi:

1) Il caso di errore di Maggio S.r.l. nell´inserimento ordine, nella spedizione o consegna. 2) Nell´ipotesi in cui Maggio S.r.l. decida a propria discrezione, ovvero concordi con il cliente, di applicare una disciplina di maggior favore per il cliente. La merce viene resa franco nostro magazzino centrale Maggio S.r.l. di Rutigliano (Bari) o punti vendita periferici. Salvo diverse disposizioni del committente, la spedizione avviene in porto franco con addebito in fattura delle spese di porto sulla base di particolari condizioni stipulate coni rispettivi vettori. Il materiale viaggia a rischio e pericolo del committente, anche se spedito in porto franco. Eventuali reclami possono essere accettati soltanto se notificati a mezzo lettera, fax o email entro otto giorni dalla data di ricevimento del materiale; trascorso tale periodo decade ogni diritto di reclamo.

8. CONTRIBUTO FISSO: Per ogni spedizione, in aggiunta al costo della stessa, verrà addebita- to in fattura l`importo di €4,20 corrispondente al contributo fisso calcolatoin via forfettaria.

9. RESI DA CLIENTE: La merce dovrà essere inviata in porto franco al nostro magazzino centrale di Rutigliano (Bari) presso i nostri punti vendita.

10. CONDIZIONI GENERALI DI ACCETTAZIONE DEI RESI PER TUTTI IPRODOTTI: Vostra bolla di reso riportante n° bolla di riferimento Maggio S.r.l. codice cliente e motivazione chiara del reso Prodotti Maggio S.r.l. non danneggiati Imballaggi ed etichette integri o nelle stesse condizioni di fornitura. Prodotti non acquistati in regime di promozione, anche se reso totale.

Prodotti resi non oltre un mese dalla data di ricezione merce.

11. PER PRODOTTI SPECIALI: I prodotti non a catalogo, o comunque forniti in base alle speciali esigenze del cliente, sono accettati solo se la merce consegnata non è conforme alle condizioni e specifiche indicate nell´ordine.

12. PENALI E SPESE: In caso di errore del cliente sarà applicata una penale massima corrispondente al 20% del valore della merce stessa e saranno addebitate le spese di trasporto.

In caso di errore causato da Maggio S.r.l. o dal corriere non saranno addebitate alcune penali o spese di diversa natura.

13. GARANZIA: Maggio S.r.l. fornisce un servizio completo incluso nel prezzo di listino nei seguenti termini: 1 anno di garanzia per tutte le macchine/attrezzature di nuova costruzione.

Per la concessione della garanzia va presentata copia della fattura di vendita completa della data di fornitura, del tipo e numero di matricola dell´attrezzo/macchina. Per tutti gli attrezzi/

macchine da riparare è necessario contattare il numero Maggio S.r.l. – Servizio Assistenza Clienti 080.476.10.25 che provvederà al ritiro gratuito dell´attrezzo tramite corriere.

14. RIPARAZIONI IN GARANZIA: Per la validità della garanzia è indispensabile che límpiego delláttrezzo/macchina sia corretto sulla scorta delle norme contenute nel “manuale dís- truzioni” e che non vengano eseguite modifiche o riparazioni nè dal cliente nè da parti terze.

La garanzia comprende la riparazione e la sostituzione gratuita delle parti difettose. Difetti dovuti a naturale usura, a manomissioni e ad uso errato sono esclusi dalla garanzia. Il difetto va dichiarato immediatamente al suo manifestarsi e per la validità è necessario che siano soddisfatte le condizioni di fornitura. Maggio S.r.l. non è responsabile in nessuna circostanza per danni, perdite o maggiori costi in relazione o a causa dellímpiego o incapacità di utilizzo delláttrezzo per qualsiasi motivo. Maggio S.r.l. fornisce per gli attrezzi/macchine la garanzia descritta nei rispettivi “manuali dístruzioni”. Questa è la sola garanzia offerta e sostituisce qualsiasi altra garanzia scritta od orale.

15. FORO COMPETENTE: Il foro di Bari ha competenza per qualunque controversia possa in- sorgere in relazione all´acquisto dei prodotti Maggio S.r.l..

purposes, namely, related to their professional activity. The relationship between Maggio S.r.l.

and customers will not be however disciplined under the regulations of consumer protection, in particular the DLgs 185/1999(contracts settled at distance), DLgs 50/1992 (right to can- cel), DLgs24/2002, Law 126/1991 and Articles 1469 and ss c.c.

2. PRICES: The prices listed in the price list are expressed in Euros €. Every expressedprice refers for one only piece of each product. All prices are VAT exclusiveand not inclusive ship- ping costs.

3. QUOTATION REQUEST: Any quotation request, whether submitted by telephone, fax, ver- bally orother means, shall not represent an “executive sales order” in all cases. Asa result to such requests, the company will act exclusively to provide thevery requested information.

4. ORDER PROPOSAL: The customers of Maggio S.r.l. -who have entered into specific agre- ements with Maggio S.r.l., in the sense that they are already in possession of the relevant customer code- will submit order proposals through the appropriate pre-printed form. Such proposals shall not represent purchase in any manner, since these are simple proposals who- se finalization is subject to the approval of Maggio S.r.l..

5. PAYMENT: In case of delayed payment (beyond the deadline of the invoice), that interests that shall be charged are equal to the legal interests increased by three points.

6. INVOICES: Any claims or objections about the invoices will be accepted on condition that they reach the headquarter of Maggio S.r.l., or by letter, fax and email to the different points of sale not later than eight days from the receipt ofthe invoice it self.

7. RETURNED GOODS: The following provisions related to returned goods will be applied in two different cases: a) In case of error on the part of Maggio S.r.l. in the entry of an order, shipment or consignment. b) In the event that Maggio S.r.l. decides at its own discretion or rather agrees with the customer to apply a regulation of reater benefit to the customer. Goods shall be returned on customer’s charge at our central warehouse Maggio S.r.l. in Rutigliano (BA) or at our suburban points of sale. Unless differently provided by the customer, the shipment takesplace in free port, transport charge shall be included in the invoice. Thematerial shall transported at the buyer’s risk even if the shipment takes place in free port. Any complaints can only be accepted if reported byletter, fax or email with in eight days of receipt of the ma- terial. Any right of claim lapses after this period.

8. FIXED CONTRIBUTION: For each shipment, in addition to its cost, it will be invoiced the amount of€ 4,20 corresponding to the fixed amount calculated as a lump sum.

9. CUSTOMER’S RETURNED GOODS: Goods shall be returned on customer’s charge at our central warehouse Maggio S.r.l. in Rutigliano (BA) or at our suburban points of sale.

10. GENERAL CONDITIONS OF ACCEPTANCE OF ALL RETURNED GOODS: Your return delivery note, that shows: reference number related to Maggio S.r.l., customer code and clear motivation of returning. Undamaged Maggio S.r.l. products. Undamaged packaging and labels, i.e.

under the same supplying conditions. Products which are not purchased in the promotion scheme, even if totally returned. Products shall be returned by 30 days from the date of receipt of goods.

11. SPECIAL PRODUCTS: Products, which are not listed in catalog, but are supplied anyway according to customers’ needs, shall be accepted only if the deliveredgoods do not comply with the conditions and specifications stated inthe order.

12. PENALTIES AND EXPENSES: In case of a customer error, a maximum penalty -that equals to 20% ofthe goods value- shall be charged, in addition to transport costs. In case of error made by Maggio S.r.l. or by the carrier, neither penaltiesn or any other costs of different nature shall be charged.

13. WARRANTY: Maggio S.r.l. provides a complete service included in the price list in the following terms: One year of warranty for all the newly constructed machinery and equipments.

The concession of warranty requires to present a copy of the sales invoice, complete of date of delivery, type and serial number of the machinery/equipments. For all the equipments to be repaired, you should contact the customer service telephone number(+390804761025) of Maggio S.r.l., that will be available for a free-ofchargecollection of equipments by a carrier.

14. WARRANTY REPAIR: For the validity of the warranty, it is essential that the utilization of the equipments have to occur in the correct way, on the basis of the regulations described in the user’s hand book, and that no modifications or repairs have been carried out by the customer or by third parties. The warranty covers the repair and replacement of defective parts.

Defects due to natural usury, mishandling and incorrect use are excluded from the warranty.

Defects must announced immediately. Validity of warranty requires also that the conditions of supply are fulfilled. Maggio S.r.l. is not responsible under any circumstances for damages, losses or costs increments, as a result of use or inability to use the machinery for any reason.

Maggio S.r.l. provide machinery with the guarantee described in the relevant user’s handbook.

This is the only offered warrantyand it replaces all other written or verbal warranties.

15. PLACE OF JURISDICTION: The jurisdiction of the Courts of Bari has jurisdiction in any disputearising in connection with purchase of Maggio S.r.l products.

3. DEMANDE DE DEVIS : Toutes demandes de devis transmises par fax, téléphone, oralement et autre ne représentent en aucun cas une «commande exécutive de vente». Suite à de telles demandes, la société s’activera exclusivement afin de fournir les informations faisant l’objet de- sdites demandes.

4. PROPOSITION DE COMMANDE : Les clients de la société Maggio S.r.l. déjà en possession du code client approprié et ayant stipulé avec Maggio S.r.l. des accords spécifiques en ce sens pour- ront envoyer des propositions de commande en remplissant la fiche pré-imprimée prévue à cet effet. Ces propositions ne représentent nullement un achat car il s’agit de simples propositions dont la finalisation est subordonnée à l’acceptation en bonne et due forme de Maggio S.r.l.

5. PAIEMENT: En cas de paiement tardif dépassant les délais prévus par la facture, les intérêts seront débités dans une mesure égale aux intérêts légaux majorés de trois points et frais corre- spondants.

6. FACTURES: Toute réclamation ou contestation sur des factures sera acceptée à condition qu’elle parvienne au siège de Maggio S.r.l. ou à ses différents points de vente par lettre, fax ou courriel dans un délai de huit jours à compter de la date de réception de la facture en question.

7. RETOURS : Les dispositions suivantes en matière de Retours de marchandises seront appli- quées dans ces deux cas de figure : 1) En cas d’erreur de Maggio S.r.l. dans la saisie de la commande, dans l’expédition ou la livraison. 2) Si Maggio S.r.l. décide à sa discrétion ou concorde avec le client d’appliquer un traitement plus favorable pour le client. La marchandise est rendue franco notre magasin central de Maggio S.r.l.

De Rutigliano (Bari) ou points de vente périphériques. Sous réserve de dispositions différentes du donneur d’ordre, l’expédition a lieu en port franc avec prélèvement sur la facture des frais de transport sur la base de conditions particulières stipulées avec les transporteurs respectifs. Le matériel voyage aux risques et périls du donneur d’ordre même s’il est expédié en port franc. Tou- te réclamation ne sera acceptée que si elle est notifiée par lettre, fax ou courriel dans les huit jours qui suivent la date de réception du matériel; une fois cette période écoulée, tout droit de réclamation tombe.

8. CONTRIBUTION FIXE : Pour chaque expédition, en plus de son coût, le montant de 4,20 EUR, correspondant à la contribution fixe calculée à titre forfaitaire, sera débité.

9. RETOURS DE LA CLIENTÈLE : La marchandise devra être envoyée en port franc à notre magasin central de Rutigliano (Bari) ou dans nos points de vente.

10. CONDITIONS GÉNÉRALES D’ACCEPTATION DES RETOURS POUR TOUS LES PRODUITS : Votre bon de retour reportant le n° du bon de référence Maggio S.r.l., le code du client et la motivation claire du retour Produits de Maggio S.r.l. non endommagés Emballages et étiquettes intacts ou dans les mêmes conditions de fourniture Produits non achetés sous le régime de la promotion, même en cas de retour intégral Produits rendus au plus tard un mois après la date de réception de la marchandise.

11. POUR LES PRODUITS SPÉCIAUX: Les produits ne figurant pas au catalogue ou dans tous les cas fournis sur la base d’exigences particulières du client ne seront acceptés que si la marchandise livrée n’est pas conforme aux conditions et aux spécifications indiquées dans la commande.

12. PÉNALITÉS ET FRAIS: En cas d’erreur du client, une pénalité maximum correspondant à 20%

de la valeur de la marchandise en question sera appliquée et les frais de transport seront débités.

En cas d’erreur causée par Maggio S.r.l. ou par le transporteur, aucune pénalité ni frais de nature diverse ne seront prélevés.

13. GARANTIE : Maggio S.r.l. fournit un service complet inclus dans le prix de catalogue selon les délais suivants : 1 an de garantie pour toutes les machines et tous les équipements de fabrication récente. Pour l’octroi de la garantie, il faudra présenter un exemplaire de la facture de vente portant la date de fourniture, le type et le numéro de série de l’outil/machine. Pour tous les outils/

machines à réparer, il est nécessaire de contacter par téléphone au numéro 080.476.10.25 le Service Assistance à la Clientèle de Maggio S.r.l. qui procèdera au retrait gratuit de l’outil/machine moyennant transporteur.

14. RÉPARATIONS SOUS GARANTIE : Pour la validité de la garantie, il est indispensable que l’emploi de l’outil/ machine soit correct, à savoir conforme aux normes contenues dans le «Manuel d’utilisation» et que le client ou des tiers n’y aient pas effectué de modifications ou de réparations.

La garantie comprend la réparation et le remplacement des parties défectueuses. Les défauts dus à l’usure naturelle, à des altérations et à une mauvaise utilisation sont exclus de la garantie. Le défaut doit être déclaré aussitôt qu’il se manifeste et il est nécessaire, pour qu’il y ait validité, que les conditions de fourniture soient remplies. Maggio S.r.l. n’est en aucun cas responsable de dom- mages, pertes ou coûts supplémentaires relativement à ou à cause de l’emploi ou de l’incapacité d’utilisation de l’outil pour quelque raison que ce soit. Maggio S.r.l. fournit pour les outils/machines la garantie décrite dans les «Manuels d’utilisation» respectifs. C’est la seule garantie offerte et elle remplace toute autre garantie écrite ou orale.

15. TRIBUNAL COMPÉTENT : Le Tribunal de Bari sera le seul compétent en cas de litige survenant relativement à l’achat des produits Maggio S.r.l.

It is an inter-row combined machine with right-sided single blade, used only for the cultivation of inter-rows, vineyards and orchards, which adapts to the row width by means of the hydraulic regulation system.LAMAX-SC can install only two interchangeable accessories of which one is the inter-row blade and the other is the plowshare.

C’est une machine inter-rang combinée à bras unique côté droit, utilisée uniquement pour les travaux des inter-rangs de vignobles et vergers, s’adaptant à la largeur du rang grâce au système hydraulique de réglage.Il est possible de monter sur LAMAX-SC deux accessoires interchangeables seulement: l’un est la lame inter-rang et l’autre est le soc avec versoir.

È una attrezzatura interfilare combinata a braccio singolo lato DX, utilizzata solo per lavorazioni degli interfilari, di vigneti e frutteti, adattandosi alla larghezza del filare attraverso il sistema idraulico di regolazione.LAMAX-SC, ha la possi- bilità di montare solo 2 accessori intercambiabili di cui uno è la lama interfilare e l’altro è il vomere scolmatore.

C’est une machine inter-rang combinée à double bras côté droit/gauche, utilisée uniquement pour les travaux des inter-rangs de vignobles et vergers, s’adaptant à la largeur du rang grâce au système hydraulique de réglage.

Il est possible de monter sur LAMAX-DC deux accessoires interchangeables seulement: l’un est la lame inter-rang et l’autre est le soc avec versoir. Est également réversible car peut être utilisée aussi bien à l’arrière qu’à l’avant du tracteur.
