“Trial”), described in protocol n.

- whereas in the meeting of February 18, 2020 Ethics Committee named Comitato Etico Unico Regionale (below for brevity the “CEUR”), to which the CROB refers, gave a favorable opinion on the Amendment Substantial Change Principal Investigator;
the Parties desire with this Amendment n. 1 to amend the terms of the Agreement as set forth herein.

che, le Parti desiderano modificare con il presente Emendamento n. 1 i termini del Contratto, come in esso enunciati.
WITNESSETH, the Parties agree as follows:
TUTTO CIÒ PREMESSO, le Parti concordano quanto segue:
1. From 27 December 2019 Dr.
Giuseppe Pietrantuono has replaced Dr. Pellegrino Musto in his capacity as Principal Investigator for the Study and shall assume all responsibilities and obligations of the Investigator as set forth in the Agreement.. Where present in the Agreement and in the Amendment n. 1 the word
“Principal Investigator” shall be referred to Dr. Giuseppe Pietrantuono.
1. Dal 27 dicembre 2019 il Dott.
Giuseppe Pietrantuono ha sostituito il Dott. Pellegrino Musto nella sua qualità di Sperimentatore Principale dello Studio e si assume tutte le responsabilità e gli obblighi dello Sperimentatore Principale come stabilito nel Contratto. Laddove presente nel Contratto e nell’Emendamento n. 1, il termine
“Sperimentatore Principale” andrà riferito al Dr. Giuseppe Pietrantuono.
2. Upon execution, this Amendment n.
1 shall be made a part of the Agreement and shall be incorporated by reference therein.
2. Al momento dell’esecuzione, il presente Emendamento n. 1 diverrà parte integrante del Contratto e dovrà esservi incorporato per riferimento.
3. All other terms and conditions of the Agreement shall remain in full force and effect. In the event of any conflict between the terms of the Agreement and this Amendment n.

Any contrary act will be considered as null and never happened

4. This Amendment is drafted in Italian and English; in case of any dispute the Italian language will prevail.
This Amendment is drawn up in a single computer copy and signed with a digital signature pursuant to articles 20 and following and 24 of Legislative Decree 82/2005, subject to the provision of art. 15, paragraph 2 bis of Law 241/1990, as added by art. 6, Legislative Decree 18.02.2012, n. 179, converted into Law 17.12.2012, n.

The taxes and duties regarding and resulting from entering into this amendment are charged to PPD, including stamp duty and registration tax.
The stamp duty is paid virtually pursuant to art. 15 DPR 642/72 with authorization N. 28877/2015 dated 5 February 2015 by the Tax Agency – Ufficio Territoriale Milano 2.
This Amendment is subject to registration only in the event of use, and to a fixed fee pursuant to the second paragraph of Article 5 and Article 40 of the Consolidated Law which regulates the registration tax, enforced by Presidential Decrees no. 131 and 132 of April 26, 1986.
4. Il presente Emendamento è redatto in italiano e in inglese, in caso di contrasto prevarrà il testo di lingua italiana.
Il presente Emendamento è redatto in un unico esemplare informatico e sottoscritto con firma digitale ai sensi degli articoli 20 e ss. e 24 del D.Lgs.
82/2005, giusta la previsione di cui all’art. 15, comma 2 bis della Legge 241/1990, come aggiunto dall’art. 6, D.L. 18.02.2012, n. 179, convertito in Legge 17.12.2012, n. 22.Sono a carico di PPD le imposte e tasse inerenti e conseguenti alla stipula del presente Emendamento ivi comprese l’imposta di bollo e l’imposta di registro.
L’imposta di bollo viene assolta in modo virtuale ai sensi dell’art. 15 DPR 642/72 con autorizzazione N.
28877/2015 del 5 febbraio 2015 dell’Agenzia delle Entrate - Ufficio Territoriale Milano 2.
Il presente Emendamento è soggetto a registrazione solo in caso d’uso, e a tassa fissa ai sensi del secondo comma dell'Articolo 5 e dell’Articolo 40 del Testo unico che regola l'imposta di registro, reso esecutivo dai Decreti Presidenziali n. 131 e 132 del 26 aprile 1986.
